SynopsisThis presentation provides an historical and conceptual overview of Aristotle’s constitutional theory and also develops and defends a broadly Aristotelian account of constitutional legitimacy in the contemporary context. I begin the presentation by mapping out similarities and differences between the Aristotelian concept of the politeia and the contemporary concept of a written constitution. Having established the applicability of Aristotle’s theory of the politeia to modern debates on constitutional legitimacy, I then argue that Aristotle’s appeal to the common advantage offers a more solid normative foundation for constitutional legitimacy than concepts such as constituent power and popular sovereignty. |
